King FreeForm™ Product

120 Day FreeForm™ Trial Offer

Terms and Conditions

 


Offer commences 15 November 2025.

Deposit must be received: on or after 15 November 2025.


1. INTRODUCTION  

1.1 The 120 Day FreeForm Trial promotional offer (120 Day FreeForm Trial, in these T&C, also called the Offer) applies when you purchase a King FreeFormTM Product (as later defined) for Personal Use. The Offer does not apply:

      (a) if a FreeForm Product is purchased for a Commercial Use (that is, not for Personal Use); or

      (b) when you purchase a product which is not a FreeForm Product.

1.2 These T&C govern scope of the Offer. The 120 Day FreeForm Trial is offered in addition to the King FreeForm Product Warranty which is separately described, elsewhere.

1.3 The 120 Day FreeForm Trial period commences on the date the FreeForm Product is delivered to you, the purchaser, and ends 120 days after that date (Trial Period). No activation or registration is required. 

1.4 It is important to note that, if you decide to return the FreeForm Product under the terms of this Offer: 

     (a) you must pay the Return Fee (as later defined). 

     (b) the Return Fee will be deducted from your refund; and

     (c) any delivery fee previously paid by you is not refunded.

 

2. WHAT ARE THE BENEFITS OF THE 120 DAY FREEFORM TRIAL?

2.1 If, before the end of the Trial Period, you are not satisfied with the FreeForm Product for any reason, (including comfort, size, colour, configuration or if you decide the product is not right for your preferences), King Living will:

     (a) collect the FreeForm Product from your Eligible Customer Address (as later defined) and subject to Collection Limitations described in clause 4, below;

     (b) provide you with a refund of the purchase price paid by you for the FreeForm Product after deducting and retaining the Return Fee. 

 

3. WHAT ARE THE CONDITIONS OF THE 120 DAY FREEFORM TRIAL?

3.1 To receive the benefits of the 120 Day FreeForm Trial, all of the following eligibility criteria must be satisfied:

     (a) Before the end of the Trial Period, you must submit a return request via King Living’s Customer Service department, (using the Contact Details at the end of the T&Cs), stating why you are not satisfied with the FreeForm Product.

     (b) You must have used the FreeForm Product for at least 14 successive days during the Trial Period.

     (c) You must cooperate and allow King Living to take possession of the FreeForm Product in accordance with the Collection Limitations described in clause 4, below.

     (d) The FreeForm Product must be complete (including all modules, legs, hardware, and accessories), clean and undamaged at the time of collection by King Living.

     (e) You have not previously made a claim for a refund under this Offer (Refund Claim) in respect of a FreeForm Product with the same name.

     (f) You have paid and King Living has received the full purchase price for the FreeForm Product.

     (g) The FreeForm Product has been used solely by you and exclusively for your Personal Use.

     (h) The FreeForm Product has not been removed from the country where it was purchased.

3.2 You must use and maintain the FreeForm Product in accordance with the care instructions for the relevant product as provided on King Living’s website and any other information made available to you by King Living. If a component of a FreeForm Product becomes defective, you must not attempt to repair it yourself. Doing so may cause damage to the product and make you ineligible to receive the benefit of this 120 Day FreeForm Trial.

3.3 If you make a Refund Claim you are automatically deemed to authorise King Living to deduct the Return Fee from your refund.

 

4. COLLECTION LIMITATIONS

4.1 If your address is within an Eligible Customer Address, King Living will arrange to collect the FreeForm Product from that address (generally, on the next available delivery timeslot for collection of the item). Please note, arranging a return collection may take 2–3 weeks, or longer, depending on fluctuations on demand and resources available to King Living at that time.

4.2 If your address is outside of an Eligible Customer Address, you must make your own arrangements (at your expense) to return the FreeForm Product to a King Living warehouse or other venue nominated by King Living. Please note: 

     (a) King Living will not reimburse any additional transport costs or expenses incurred by you for returns from outside of an Eligible Customer Address;

     (b) You remain liable to pay the Return Fee.

 

5. REFUNDS

5.1 King Living will refund the purchase price of the FreeForm Product, (after deducting the Return Fee), after the returned FreeForm Product has been received, inspected and approved by King Living. The refund will be processed and must be paid to the same payment method used for the original purchase. Refunds are typically received 5 to 7 business days after the refund is approved by King Living. Any delivery fee previously paid by you is not refunded.

5.2 If King Living determines (after inspection) that the FreeForm Product is damaged, incomplete, or otherwise fails to meet the conditions of this 120 Day FreeForm Trial (an Invalid Refund Claim) then:

     (a) the purchase price of the FreeForm Product will not be refunded; 

     (b) King Living will notify you and you must elect: 

          (i) for King Living to return the FreeForm Product to your Eligible Customer Address (and at your cost, subject to our standard delivery fees); or

          (ii) to collect the FreeForm Product from our location within 7 days after notification from King Living. 

5.3 If you make an Invalid Refund Claim and you do not make a timely election or if you fail to promptly take delivery or exercise collection in accordance with your election, King Living has the right to dispose of the FreeForm Product without refunding the purchase price or any further notice to you; and

5.4 Any costs incurred by King Living in connection with an Invalid Refund Claim, including freight, call-out fees, labour or other associated costs may be charged to you at King Living’s standard rates.

 

6. WHAT IS EXCLUDED FROM THE 120 DAY FREEFORM TRIAL?

6.1 This 120 Day FreeForm Trial applies only to the original purchaser of the FreeForm Product. The Offer cannot be assigned or transferred.

6.2 This 120 Day FreeForm Trial does not apply:

     (a) if the FreeForm Product is purchased or used for a Commercial Use;

     (b) to any exclusions specifically listed in these Terms and Conditions; 

     (c) if the FreeForm Product has not been purchased directly from King Living; 

     (d) if the FreeForm Product (including any component part) has been modified, altered or repaired without King Living’s written approval or if it is damaged or soiled; and

     (e) if any product tag, serial number, or identification label on the FreeForm Product has been removed, altered or defaced.

6.3 Any delivery fee previously paid by you is not refunded.

 

7. HOW DO YOU MAKE A REFUND CLAIM?

7.1 In order to make a Refund Claim you must notify King Living’s Customer Service before the end of the Trial Period, using the Contact Details at the end of these terms and conditions.

7.2 When making your Refund Claim you must notify King Living of:

     (i) your name; 

     (ii) order delivery address (Where was the FreeForm Product delivered?); 

     (iii) your phone number; 

     (iv) King Living product details for the FreeForm Product; 

     (v) date of purchase; 

     (vi) reason why you are not satisfied with the FreeForm Product.

7.3 After notification is received by King Living, a Customer Service representative will initially check your Refund Claim and then inform you about next steps relevant to collection and processing of your Refund Claim.

7.4 Our Customer Service representative may ask you reasonable questions which are for the purpose of determining whether you are eligible to receive the benefits of this Offer. You must answer the questions in full, promptly and truthfully.

7.5 King Living reserves the exclusive right, acting in good faith, to determine whether you are eligible to receive the benefit of the 120 Day FreeForm Trial.

 

8. DISCLAIMER

8.1 To the extent permitted by law, King Living will be under no liability in contract or, tort (including without limitation, negligence, or breach of statutory duty) to compensate you for:

     (a) any expenses incurred by you or a third party; 

     (b) any loss of profit, revenue, business, contracts or anticipated savings; 

     (c) any loss or expense resulting from a claim by a third party; 

     (d) any special, indirect or consequential losses or damages caused by King Living’s failure to complete or delay in completing any of its obligations in this Offer.

 

9. LIMITATIONS ON DISCLAIMER

9.1 The benefits given by this 120 Day FreeForm Trial are additional to other rights and remedies that you may have in relation to our products. Any clause of these Terms and Conditions which is unenforceable or void is to be severed and the other terms will remain in force.

 

10. DEFINITIONS

Commercial Use means any use which is not Personal Use (as later defined). Commercial Use includes, without limitation, any of the examples listed in the table directly below:

Placement in short‐stay rentals (including Airbnb and similar platforms)

 

Eligible Customer Address means an address which is within the metro area of any city where a King Living showroom is located. This is an important geographic limitation: Collections are not available if the FreeForm Product is located outside of an Eligible Customer Address when the Refund Claim is made. Please check with King Living staff to find out whether your address is an Eligible Customer Address.

FreeForm Product means a product which is advertised, promoted and sold by King Living as a FreeForm-branded product (limited to so-called compressed foam products which are delivered to customers in a compressed form). These include, for the avoidance of doubt, the King Sofa Bed; the King Lumo; the King Quantum and the King Kube.

Personal Use means use of a product in an owner-occupied or privately rented residence, and solely for the private enjoyment of the permanent occupant; and is not used for furnishing commercial business premises or in the context of any commercial guest accommodation.

Return Fee means the flat fee of CAD 99 which is a partial subsidy of King Living’s estimated costs of restocking and processing the refund.
