King Freeform™ Product

Warranty Terms (Personal Use)

 

1. SCOPE OF WARRANTY

1.1 These Warranty Terms apply where a Freeform™ Product (as later defined) is purchased for Personal Use (as later defined). These Warranty Terms do not apply:

      (a) if a Freeform Product is purchased for a Commercial Use (that is, not for Personal Use);

      (b) if, within 90 days after the date of delivery, you fail to completely unpack your compressed Freeform Product (and you fail to allow it to form its uncompressed shape); or 

      (c) when you purchase a product that is not a Freeform Product.

1.2 King Living warrants all Freeform Product(s) and selected components of those products, as specified in this warranty, against failure due to a manufacturing defect for the period referred to in the below table (Warranty Period), subject to these terms (Warranty).

1.3 The King Warranty is expressly excluded in relation to a Freeform Product. This King Freeform Product Warranty applies to the exclusion of, and supersedes the King Warranty.

1.4 King Living reserves the right to change the terms of the Warranty at any time. If we do make a change, we will continue to honour the terms of the Warranty which was in effect at the time when you purchased a Freeform Product which is covered by this Warranty.

1.5 Each Warranty is specific to a Freeform Product or a component of a Freeform Product as described in the following table. Please note the exclusions to this Warranty that are listed in this document and the specific exclusions for each specific product and component warranty listed in the following table.

2. WHAT IS NOT COVERED BY THE WARRANTY?

2.1 These Warranty Terms do not apply:

      (a) If the Freeform Product is purchased or used for a Commercial Use;

      (b) If, within 90 days after the date of delivery, you fail to completely unpack your compressed Freeform Product (and you fail to allow it to form its uncompressed shape);

      (c) to any exclusions specifically listed for the relevant product or component in the above table; 

      (d) If the Freeform Product or component:

          (i) has not been purchased directly from King Living; 

          (ii) has had any product tag, serial numbers or identification label removed, altered or defaced; 

          (iii) has been modified or changed without approval from King Living; or

          (iv) has been removed from the country where it was purchased.

      (d) To normal wear and tear associated with the products and components. Fabric covers, zippers, suspension components like springs, hook and loop fasteners, and foam will show signs of wear and tear with use. Fabrics will fade and crease. Foam will soften and form to the shape of the user over time. Depending on the degree of use, the fabric covers, zippers, foam and spring suspension may need to be replaced periodically at the purchaser’s expense. King Living reserves the right to determine at its discretion whether a component has failed due to a defect or normal wear and tear. Refer to the discussion of normal wear and tear in clause 2.2, below. Any item requiring replacement due to wear and tear will be at your own expense;

      (e) To colour variations caused by exposure of fabric covers to harsh or adverse environmental conditions; 

      (f) To comfort preferences, including dissatisfaction with the level of firmness, softness or support of the product where no manufacturing defect exists;

      (g) To damage caused by use of components that are not the genuine manufacturer’s components. 

      (h) To products or components that become defective as a consequence of misuse, lack of proper care and maintenance, Commercial Use or handling in transit. You must use and maintain the Freeform Product in accordance with the care instructions for the relevant component as provided on King Living’s website and any other information made available to you by King Living. If a component of a product becomes defective, you must not attempt to repair it yourself. Doing so may cause damage which is not covered by this Warranty.

2.2 Concerning normal wear and tear with the foam in Freeform Products: Over time, the foam in Freeform Products will naturally soften and conform to the way in which it is used. When first manufactured, the foam is in a relatively firm, crystalline state that has not yet been “worn in.” The foam may soften by up to approximately 15% within the first 3–6 months, depending on frequency and conditions of use. This natural adjustment is a normal characteristic of high-quality foam. It does not indicate a fault or defect in the product. The foam will continue to gradually soften throughout the product’s life as part of normal wear and tear.

2.3 This Warranty is solely for the benefit of and applies only to the original purchaser of the Freeform Product. You cannot assign or transfer any benefit conferred by this Warranty. 

 

3. HOW DO YOU LODGE A WARRANTY CLAIM?

3.1 You must notify King Living Customer Service promptly when any defect occurs. Use the Contact Details shown at the end of these Warranty Terms. You must provide the following information when you notify us of the defect:

  • Your name;
  • Order delivery address;
  • Your phone number;
  • King Living product details (including batch labels or serial numbers); and
  • Details of the defect claimed.

If you do not provide that information, it may delay our ability to process your claim in a timely manner, or we may deny your claim.

3.2 After we receive your notification, a representative of King Living Customer Service will determine whether your warranty claim is valid, and if it is, will inform you how King Living will honour it. To help us make that determination, you may be required to provide King Living with:

  • Photographic evidence of the defect;
  • A written explanation of the defect;
  • Details of the defect over the phone with King Living Customer Service.

3.3 During the process, King Living Customer Service may, before providing the warranty service, require that you respond to questions designed to assist with diagnosing potential faults and follow their procedures for obtaining the Warranty. You must respond to all requests promptly. King Living reserves the right in its absolute discretion to determine whether a component has failed due to a defect or wear and tear.

3.4 If you submit a warranty claim and if we decide that one of our service technicians needs to conduct a service visit, the standard fee for that service visit will be charged in advance. If we subsequently determine that your warranty claim is valid, that standard fee will be refunded in full. Where a warranty claim is determined to be valid, King Living will only be responsible for costs that have been pre-approved in writing by King Living. Any costs incurred without King Living’s written pre-approval are excluded from this Warranty.

 

4. HOW WILL A VALID WARRANTY CLAIM BE HONOURED? 

4.1 All warranty claims determined by King Living Customer Service to be valid will be honoured. 

4.2 To honour a warranty claim relating to a Freeform Product, King Living will, at its option:

      (a) Refund the price which you paid for the Freeform Product; or

      (b) Replace the Freeform Product or supply an equivalent product; or

      (c) Repair the Freeform Product; or

      (d) Pay the cost of having the Freeform Product repaired.

4.3 As a condition of any refund or replacement, we may require you to:

      (a) allow us to collect the Freeform Product first; or

      (b) deliver the Freeform Product to a facility or location nominated by us.

4.4 Once the refund has been issued or the product has been replaced, the returned product becomes the property of King Living. 

4.5 Components replaced under this Warranty may vary in colour and texture to the original and such variations are not considered a defect.

4.6 Any repair or replacement under this Warranty is limited to the defective component only.

 

5. DISCLAIMER

5.1 To the extent permitted by law, all other warranties implied or otherwise not set out in this Warranty are excluded. King Living will be under no liability in contract, tort (including without limitation, negligence), or breach of statutory duty to otherwise compensate the party eligible to make a warranty claim for: 

      (a) any expenses incurred by the claimant or a third party; 

      (b) any loss of profit, revenue, business, contracts or anticipated savings; 

      (c) any loss or expense resulting from a claim by a third party; 

      (d) any special, indirect or consequential losses or damages caused by King Living’s failure to complete or delay in completing any of its obligations in this Warranty.

 

6. DEFINITIONS

Commercial Use means any use which is not Personal Use (as later defined). Commercial Use includes, without limitation, any of the examples listed in the table directly below:

Freeform Product means a product which is advertised, promoted and sold by King Living as a Freeform-branded product (limited to so-called compressed foam products which are delivered to customers in a compressed form). These include, for the avoidance of doubt, the King Sofa Bed; the King Lumo; the King Quantum and the King Kube.

Personal Use means use of a product in an owner-occupied or privately rented residence, and solely for the private enjoyment of the permanent occupant; and is not used for furnishing commercial business premises or in the context of any commercial guest accommodation.
